Terms and Conditions

Terms of Appointment

Services are normally provided in terms of the following conditions:

• The “Abridged Form of Agreement for Consulting Engineering Services,– Agreement and Specific Provisions” (latest edition) as issued by Consulting Engineers South Africa (CESA) (www.saace.co.za).

• The "Guideline Scope of Services and Tariff of Fees for Persons Registered in terms of the Engineering Profession Act, 2000, (Act No. 46 of 2000) and Indicative Time Based Fees as per Government Gazette No. 31749, 2 January 2009, Board Notice 1 and 2 and issued by the Engineering Council of South Africa (ECSA) (www.ecsa.co.za).

• Schedule of Disbursements 2009 also as issued by the Engineering Council of South Africa.

For clients outside of South Africa equivalent terms and conditions, such as FIDIC guidelines and conditions, will be negotiated if required. Professional liability is limited in the conditions but may be extended per project, based on client requirements.

Fees for consulting services

The fees for consulting services are covered in the above guideline terms of appointment. Usually fees for normal services (typically design only or design and contract administration) are charged based on a percentage of the value of the engineering works. In some cases normal services however include a report stage which is charged on a time rate basis. Usually fees for additional services including analyses, investigations, inspections, audits, evaluations etc., are charged on a time rate basis or may be based, in certain cases, on a fixed fee. The fee basis is always agreed with a prospective client prior to any work being undertaken.
